and Edgar A. Winecoff,

It appearing to the satisfaction to the court, from the return made by the Sheriff on the summons and from affidavits filed in the above entitled special proceeding, that the defendant Edgar A. Winecoff, is a non-resident of this State, and after due diligence, can not be found within the State, and is a necessary and proper party to said special proceeding, and, whereas, plaintiff above named has begun said proceeding in this court to have partitioned certain real estate of David Winecoff, deceased, described in the complaint of the plaintiff and situated in No. 4 township, said county, adjoining the lands of Susan Wilkerson, Isaac Goodnight, C. M. Petrea and others.
And whereas, said defendant, Edgar A. Winecoff, has an interest, as heir-at-law, of said David Winecoff, in said real estate, now, therefore, said Edgar A. Winecoff, defendant, is hereby notified that unless he be and appear at the office of the Clerk of the Superior Court, of said county and State aforesaid on or before the 12th day of November, 1897, and plead, answer or demur to the complaint of the plaintiff in said special proceeding that the plaintiff will apply to the Court for relief demanded in the complaint and for costs.
