vs.
James G. Groner, defendant
It appearing to the satisfaction of the court, from the returns of Wm. Propst, sheriff of Cabarrus county, N. C., and from the affidavit of H. S. Puryear, filed in the above entitled action, that James G. Groner is a non-resident of this State, and after due dilligence cannot be found within the State of North Carolina, and is a necessary and proper party to the above entitled action, and whereas the plaintiff above named has begun an action in said court for a divorce: Now, therefore, the said James G. Groner is hereby notified that unless he be and appear before the judge of our Superior Court at a court to be held for the county of Cabarrus at the courthouse, in Concord, on the 8th Monday after the 1st Monday in September, 1889, and plead, answer or demur to the complaint of the plaintiff, which will be deposited in the office of the clerk of Superior Court within the first three days of said term, that the plaintiff will apply to the court for the relief demanded in the complaint and for costs of action.
